Can I sell privately as well as through an estate agent?
Yes, you can but we recommend you talk to your agent and gain their consent (preferably in writing). According to the Office of Fair Trading (see this article on their website) - “If you find a buyer yourself, you don’t have to pay the estate agent’s commission”. Be sure to point out to your agent that Buyitprivately.com is a classified advertising site.
However in the unlikely event you have signed a ‘Sole Selling’ agreement (don’t confuse this with Sole Agency) then you can’t. Check the agreement.
Should I tell my estate agent?
We think it is good practice so that there is no discrepancy if you sell privately but it is entirely up to you. Your agent will probably find out if you don’t.
Where can I get more information on the legal aspect of selling through agents and privately?
The Office of Fair Trading has produced a useful website page which clearly lays out all aspects of selling your property. If you are still concerned then check the small print of your agreement.
